Direct villas booking conditions for rentals 2016

When you make a booking Direct villas will send you a “Final confirmation email with a booking reference “
for the rental of your accommodation.
Our contract with you takes effect when we send you confirmation of your booking.

Once the email with confirmation email of booking is made we are responsible to you to provide the accommodation as described on our website and your responsibility to us is to pay for it, subject to these below terms and conditions.

It is your responsibility to check this carefully , the exact dates and the total of nights to make sure this matches your booking and the confirmation email with all payment details .
If there are any differences please contact us by email .

All payments will be charged (if applicable) at the agreed rate of exchange on the date of our confirmation of booking.

Our  website prices are subject to change and can go up or down over time due to variations in the exchange rate towards the euro / pounds and due to other special offers.
We guarantee you, your price will not increase, and in order to do this in todays currency markets , it therefore follows that we cannot amend your price should a price go down.

Payments:
Can be done by bank transfer in pounds and euro

Deposit

A deposit of 35% is required to have the booking confirmed 
Please note when we send the bookingform you will have 2 -3 working days to arrange for the deposit to be send.
If the payment has not been received within this period  , we assume that you no longer wish to proceed and offer the villa to other clients.

As we have a large amount of enquiries each day we cannot wait too long for the deposit payment.

If the booking is within 8 weeks of arrival the total amount must be paid immediately
Apartments/ hotel bookings are always due in full !
Villa bookings can be paid with a deposit payment as there are larger amounts involved.

Balance payment :

Any balance payment due must be paid no later that 8 weeks before arrival, failing to do so might result in cancellation of your booking.
OR will incur a cancellation charge (100 euro)  which needs to be paid together with the final balance to still have the booking as a confirmed booking.
( although than no guarantee is made the same accommodation will be still available for you)

Please note if balance payment is not being paid on time, we cannot guarantee your booking is confirmed !
We can only accept the balance payment by bank transfer

We, the agent need to pay our owners/ accommodations/ resorts etc in time as well, and we have contracts with them , they have the right to cancel the booking.

Extra’s pool heating or air-conditioning/ heating,

These costs are always paid separately from the rental rate and are never  included in the rental rate. Please ask our reservation department before making the reservation and we can inform your correctly.
These costs are due with the final balance payment.
Please inform us correctly at the time of booking , if you like to use the extra’s.
If extra’s  have been requested after the balance has been paid then you will need to pay this upon arrival before entering the villa. ( cash payment )
When in the description of the accommodation is no aircon / heating stated this means of course there is no heating or aircon available, we cannot be held responsible if you arrive and you assumed there was aircon or heating in the property.

If you do use the aircon units without paying for it we will charge your creditcard slip, as many times clients inform us the  aircon will no be used ,we always check the electricity meters if the aircon’ s have been used.
So please note even if the remotes are in the villa, as many times clients do like to use it because its too hot,
if you do not want the aircon please inform us upon arrival when we ar at your villa and we take them out.

If an air-conditioning unit(s)  break down during the stay of the rental client, we will do our out most best to immediately put this right , we cannot be held responsible for any refund.

If the pool heater system fails we will refund the pool heating payment back to you.

Holiday Insurance:
It is your responsibility to make sure you are adequately insured

Damage Deposit/security deposit:
A damage deposit is required to protect against accidental breakages, loss damage, key replacements and additional house keeping charges.
The damage deposit is to be paid locally upon arrival by credit card form and neither will be banked unless any fault as listed above has incurred.
We always inform our clients when we have received from our maids / or management companies if any costs have been involved before proceeding with any payment.
Please note during peak summer time ( july & august) this can take up until max 1 months after your departure day, due to the fact we have many villas arriving and departing.
The credit card voucher will be destroyed once we have been advised to do so by the owner or the management person of the villa.

If you like us to send the damage deposit back by post please request by email.

Arrival / departure time , Accommodation self catering

You may enter the villa as soon as you have the keys, however we cannot guarantee that the cleaners will have finished before 16:00, which is the arrival time on changeover days. Departure time is 10:00 unless other arrangements have been made with our office. All our villas and apartment are self catering , only upon arrival toilet paper is provided all other products like washing powder etc is for the clients to buy. Check inn official time is at 16hrs.

Route descriptions to the villas / apartments / hotels:
We arrange for our clients route descriptions from the airport to their accommodation free of charge, we do not arrange other route descriptions to water parks & golf courses etc.

Satellite/Cable TV

Please note that when there is satellite or cable TV in your chosen property, the available channels are subject to the owner’s subscription plan with the satellite/cable operator, please ask us for more details for each property.
We cannot be held responsible for any failure of the system although we do our outmost to get the right technical person to solve any situation


Atmosphere and Style of our villas.

The owners and management companies of our villas and apartments have incorporated fixtures, furnishings and equipment to their individual tastes; however please note that standards may vary.
We try to describe on the website the standard and style of each property, together with its unique charm and character.
Please note each villa has the exact amount of bath towels and linen / pillows for required per bed.
If required extra of these items, we will do all possible to confirm such requests but provision is not guaranteed, especially in HIGH/PEAK season.
When requests are made the same day , it can take 1-3 working days to have the items to the villa ( weekends not incl)
Should you need particular information regarding the size of your property or pool size or exact location / plot number of the villa, please ask us.

You can make specific requests regarding your accommodation at the time of booking, please advise.

Cots, high-chairs, Extra beds etc. are supplied on a request basis and supplementary charges will apply.
These vary according to villa/apartment and will be advised at the time of booking.
Requests must be made on your booking form or thereafter in writing.

We will do all possible to confirm such requests but provision is not guaranteed, especially in high season or when requests are made close to departure date.

You must provide your own cot linen and satisfy yourself on arrival that cots, etc. are suitable for your needs we or our agents cannot be held responsible or liable for any mishap caused through use of such items.

We do not guarantee if the cot is out of wood or will be a travel cot; no preferences can be made at all.

If in doubt, you are recommended to bring your own cot.

Cancellations – your booking is subject to the following scale of cancellation charges:
When you have paid your deposit we always forward this to the owner and we cannot do any refund of your deposit

We, the agent need to pay our owners/ management agents/ etc therefore different cancelation charges apply  for each villa please ask us at the time of booking.

Please note that with some owner of properties we have different cancellation charges so please ask us.

Cancellations must be confirmed in writing by email a and signed by the person who has done the payment.
Should the full period of rental which has been paid for not be utilized due to late arrival or early departure, we regret no refund is possible.

If clients are not satisfied with their villa the day upon arrival, and they have decided themselves to organize other accommodation, we regret no refund is possible.

Passports/Visas – We cannot accept responsibility for failure to carry valid passports, visas, licences or other necessary documentation.

Force Majeure
except where expressly stated in these booking conditions we cannot accept any liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by reason of circumstances amounting to force majeure. In these booking conditions force majeure means any event which we, or the supplier of the service’s) in question could not, even with all due care and attention, avoid. Such events may include war or threat of war, civil strife, natural or nuclear disaster, industrial dispute, terrorist activity, fire, adverse weather conditions, unforeseen local building/roadwork’s, unavoidable technical problems with transport and all similar circumstances beyond our control. Please see ‘Holiday Insurance.’ Whilst we do not exclude or limit our liability for loss or damage sustained by clients as a result of negligence by our employees or agents, this cannot extend to actions/omissions by the property owner over whom we have no direct control. Nevertheless, we will offer all reasonable assistance in the settlement of any dispute which may arise.

Complaints
whilst we endeavor to make sure that you enjoy your holiday, sometimes things go wrong.
If you have a problem or query during your holiday, please bring it to the attention in writing by email during your holiday stay.
Than we can have the opportunity to put it right. ( not after your stay ! )
If you fail to follow this procedure, we cannot accept responsibility for any claim, as we will have been deprived of the opportunity to investigate and rectify the problem.

Please note the property manager of the maintenance company of each villa ,has the right to enter in the property ( by advance notification) to make a double check if we have been informed the property is not being taken care off in the right way, or have been over-occupied.

If electrical devices suddenly break down like;  Dishwashers or a washing machines during a stay of a client /which can happen during your stay)  we will arrange an alternative, of course in the meantime we will help the clients out with extra local maid service.

Wheelchair friendly properties
Please note we do not have any wheelchair friendly property in our programm. As the villas are owned privatly. We do not take any responsibilty for having a wheelchair friendly properfty even if the property is ground floor or all on one level we cannot say its a wheel chair friendly villa. As than we can advise you to book with another company who deals with wheelchair friendly properties , please advise.

We have no control over building and road work and, due to its often intermittent nature, is not always aware when it may commence. Should building work commence during your stay, we regret we cannot accept any responsibility or liability, however, you should contact our staff and or /management company and we will endeavor to find alternative accommodation.If building work inside the property is going on as neighbors decided to change there villa or apartment inside , we cannot take any responsibility as this is out of our hands.

Direct villas has also no control over birdsnest / waspnests/ants as its nature who creates this, we regret we cannot accept any responsibility or liability over these natures.as also

Website Accuracy – we take great care to ensure the accuracy of information included on our website; however, there may be times when facilities, which are not under our direct control, may not be available. We will endeavor to inform you of any such changes in advance, although these will not in themselves entitle you to cancel your reservation without penalty. Algarve direkt acts as agent for the owners or management companies of the villas/apartments featured on this website and whilst we lay down our own minimum standards of furnishing, decoration and maintenance, we cannot guarantee that any particular feature will be available.

Photographs are intended to give an overall impression of individual villas or resorts. The company does not accept any responsibility for items of furniture, etc. which appear in photographs but may have been changed or removed, nor for any changes to aspects or views since photographs were taken or descriptions compiled.

Our Commitment to You – we plan our holiday portfolio months in advance and occasionally properties are withdrawn by owners or other circumstances make them unavailable/unsuitable for rental. Fortunately this is a very rare occurrence but we will advise you as soon as possible and always endeavor to offer an alternative property of an equal or higher standard if we are forced to make changes to your holiday plans due to circumstances outside our control. We cannot be held responsible if our owner or management company is refusing a booking ,although we try to do our outmost best to help to look for a similar alternative.

Building work and resulting disturbance from sites close to any properties featured in our program may occur at any time during the year.
Some resorts are continuing their development and local works may be taking place or may be planned.
Where we are aware in advance, as sometimes they just start in certain area’s to do any roadwork’s and we do not know these in advance, that such works are likely to occur during your holiday and may in our opinion significantly affect your enjoyment, we will advise you.

We will endeavor to offer you alternative villa accommodation (with you paying or receiving a refund in respect of any price difference) or if we are unable to offer you similar accommodation, we will refund an amount all monies paid for your villa/apartment (excluding insurance premiums and any amendment charges or any ancillary costs such as flights or car-hire).
We cannot be held at all responsible for any roadwork’s.
Vale do lobo ” praca – square ” :
Please note when we its written in our description of our Vale do lobo villas that its “not far from the praca” or maybe “a few minutes away from the praca” , you can always check with us by email ,and we send a routedescription with the exact plot number of the villa you are interested in.
( normally we have the plot number  already written on our site to avoid confusion regarding distances to the praca / square , when you book a villa with us)
As vale do lobo is a resort which over the past years have been extended quite a lot the exact distances can be better measured for the client when checking out Google earth.
We cannot be held responsible for the exact distances as written in our descriptions on our website, as this can be easily checked with having a look at Google earth.

Resort Martinhal Quinta do lago:
Please note we do not guarantee any plot number in the resort, you can let us know your preference number
but we do not guarantee golf views or other type of views of our villas.
All villas are from the similar standard.

Selling of the property

If the  owner decides to sell his property and the new owner doesn’t want to let out , this is  behind our control, if we are unable to offer you similar accommodation, we will refund all monies paid for your villa/apartment

Swimming Pools – most villas enjoy private swimming pools.
Please take great care by the pool area, especially if under the influence of alcohol, as accidents may and sometimes do occur.
We recommend that you do not dive into the swimming pool or use while under the influence of alcohol.
Children must be supervised in the swimming pool area at all times.
Pool heating, (where available) must be requested at time of booking , and needs to be paid with the final balance payment. or if upon arrival cash ( please we need to be informed before)
